Sawgrass Reports Progress in Patent Infringement Litigation

 

Mt. Pleasant, SC, October 27, 2003 - Sawgrass today announced that the Federal District Court in South Carolina has recently granted Sawgrass' motion to amend its complaint in the patent lawsuit brought against Tropical Graphics.  While Tropical Graphics vigorously opposed the motion, the court sided entirely with Sawgrass. In opposing the Sawgrass motion to amend, Tropical Graphics contended that the amendment would hurt them because they would no longer have an insurance company to pay their defense costs.  The court held that treating Tropical Graphics like any other litigant was not unfair.

 

In its amended complaint, Sawgrass dropped two claims (for injurious falsehood and false advertising) that had triggered coverage under Tropical Graphics' liability insurance policies.   Sawgrass feels that by removing these claims, the case has been reduced to fair play: both companies are now funding this lawsuit on an equal, independent basis.  Sawgrass fully believes the dropped claims are meritorious; however, they are not necessary for a resolution of the controlling issue in the case the infringement of Sawgrass' patents by Tropical Graphics.  The remaining claims are three counts for patent infringement, a claim for interference with Sawgrass' contractual relations, and a claim for violation of South Carolina's Unfair Trade Practices Act.

 

It is important that the specific outcome of these motions be reported accurately. Sawgrass will continue to report relevant activities relating to the lawsuit but as we have previously stated, we are looking to the courts as the appropriate venue to resolve all claims brought in this lawsuit.
